General Terms and Conditions of Sale

ARTICLE 1 — PURPOSE

These General Terms and Conditions of Sale hereinafter referred to as the “T&Cs” govern the contractual relationship between:

Hugo Daveluy, sole proprietor, registered under SIREN number 878 539 519, whose registered office is located at 256 Avenue de Dunkerque, 59130 Lambersart, France hereinafter referred to as the “Service Provider” or “Film Personnalisé”,

and

Any natural person acting as a consumer who makes a purchase on the website film-personnalise.com hereinafter referred to as the “Customer”.

These T&Cs apply to the sale of personalized digital content, including in particular:

  • personalized animated films Pixar-style, Claymation, Lego-like, Simpson-style,
  • personalized songs,
  • animated cards,
  • personalized audiovisual services.

These services are hereinafter referred to as the “Services”.


ARTICLE 2 — ACCEPTANCE OF THE T&Cs

Any order implies the Customer’s full and unconditional acceptance of these T&Cs. The Customer acknowledges having read and understood the essential characteristics of the Service before placing the order.


ARTICLE 3 — NATURE OF THE SERVICES

The Services offered by Film Personnalisé are personalized digital content, created based on the information provided by the Customer photos, names, occasion, story, style.

The Customer expressly acknowledges that these Services involve an artistic and creative dimension, necessarily including an element of interpretation, as well as the use of animation and artificial intelligence tools.


ARTICLE 4 — PRICES

Prices are indicated in euros, all taxes included. As a sole proprietor benefiting from the VAT exemption scheme under Article 293 B of the French General Tax Code, VAT is not applicable when this scheme applies; the mention “VAT not applicable, Article 293 B of the French General Tax Code” will then appear on the invoice.

Film Personnalisé reserves the right to modify its prices at any time. The applicable price is the price in force at the time the order is placed.


ARTICLE 5 — ORDER

The order is validated after:

  • completion of the personalized form photos, names, story, style, options,
  • acceptance of these T&Cs,
  • full payment via the secure Stripe payment module.

Film Personnalisé reserves the right to cancel an order in the event of fraud, non-payment, unlawful content, or manifestly inconsistent information.


ARTICLE 6 — RIGHT OF WITHDRAWAL

In accordance with Article L221-28 of the French Consumer Code:

The Customer expressly acknowledges that the Services constitute personalized digital content produced according to the Customer’s instructions. The Customer agrees that execution of the Service will begin immediately after validation of the order and expressly waives their right of withdrawal as soon as production begins.

However, if production has not yet begun, the Customer has the legal period of 14 days to exercise their right of withdrawal. The terms of partial reimbursement in the event that production has partially started are specified in the Refund Policy.


ARTICLE 7 — DELIVERY TIMES

The standard delivery time is 3 business days from receipt of all necessary information.

An Express 24h Delivery option (€39) is available. The delivery time may be extended in the event of:

  • incomplete information or information provided late by the Customer,
  • changes requested by the Customer,
  • exceptional periods of high activity,
  • force majeure events.

In the event of a significant delay, the Customer may request a reasonable additional period before terminating the contract, in accordance with Article L216-2 of the French Consumer Code.


ARTICLE 8 — DELIVERY

Delivery of the Service is carried out electronically, by sending a download link to the email address provided by the Customer. The Service is deemed delivered as soon as it is made available.

Any optional physical materials gift card with QR code are sent by post.


ARTICLE 9 — CONFORMITY OBLIGATION

In accordance with Articles L217-3 et seq. of the French Consumer Code, Film Personnalisé undertakes to provide a Service that conforms to the order.

In the event of non-conformity, the Customer may request:

  • correction of the Service,
  • provision of a compliant version.

The correction will be carried out free of charge when the non-conformity results from an error by the Service Provider. A full or partial refund may only occur if technical compliance is impossible.


ARTICLE 10 — REVISIONS AND MODIFICATIONS

The Customer is entitled to one (1) free revision within 7 days following delivery, allowing adjustments to details expressions, atmosphere, music, text, etc.

Modifications related to an error by the Service Provider will be carried out free of charge. Modifications resulting from a change in instructions or from elements not initially provided by the Customer may be subject to additional billing.


ARTICLE 11 — CUSTOMER’S RESPONSIBILITY

The Customer undertakes to provide accurate, complete, and usable information, and to hold the necessary rights to the photos and content submitted, including image rights of the persons represented.

The Customer shall indemnify Film Personnalisé against any third-party claim related to the content they have provided.

Film Personnalisé shall not be held liable for any lack of conformity resulting from incorrect, incomplete, or late information provided by the Customer.


ARTICLE 12 — LIMITATION OF LIABILITY

Film Personnalisé is subject to a best-efforts obligation regarding the artistic dimension of the Services. Its liability shall not be incurred in the event of:

  • artistic interpretation differing from the Customer’s subjective expectations,
  • force majeure events,
  • technical failure beyond its control hosting provider, payment service provider, third-party AI tools.

This limitation does not apply to legal conformity obligations.


ARTICLE 13 — INTELLECTUAL PROPERTY

Film Personnalisé retains all intellectual property rights over the creations produced films, animations, musical compositions, scripts.

The Customer is granted a private and personal right of use only, allowing them to view, share within a private context, and offer the film to their loved ones. Any commercial exploitation, public broadcast, or transfer to third parties for payment is prohibited without the prior written authorization of Film Personnalisé.

The Customer retains ownership of the photos and content they have provided and grants Film Personnalisé a limited license to use them solely for the purpose of producing the Service.


ARTICLE 14 — CLAIMS AND MEDIATION

In the event of a dispute, the Customer must first contact:

contact@film-personnalise.com

In accordance with Articles L612-1 et seq. of the French Consumer Code, the Customer may use a consumer mediator free of charge. The Customer may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.


ARTICLE 15 — FORCE MAJEURE

Film Personnalisé shall not be held liable in the event of an unforeseeable, irresistible, and external event preventing performance of the contract, including prolonged unavailability of third-party AI tools, hosting provider outage, natural disaster, etc.


ARTICLE 16 — PERSONAL DATA

Personal data collected in this context is processed in accordance with the Privacy Policy available on the website.


ARTICLE 17 — APPLICABLE LAW AND JURISDICTION

These T&Cs are governed by French law. Failing amicable resolution, any dispute shall be submitted to the competent French courts, in compliance with the rules applicable to consumers.
